Is sleeping in your car legal in Florida?
The answer depends on where you park and what that location permits. Florida’s public-camping statute excludes overnight lodging in a motor vehicle that is registered, insured and in a place where it may lawfully be. That exception does not authorize trespassing, ignoring a time limit or staying in a lot that prohibits overnight parking.
Car camping can mean a tent beside your vehicle, or sleeping inside it. A campground that accepts tents or RVs does not automatically accept a sedan, SUV or unconverted van as overnight sleeping equipment. Ask specifically before paying or driving there. This guide is general planning information, not legal advice.
Where can you park overnight in Florida?
Choose a location with explicit permission rather than relying on a crowdsourced pin or an old review. A full night of camping and a short fatigue break are different uses.
| Location | What permission means |
|---|---|
| Developed campground | Reserve a site and get approval for sleeping in your specific vehicle |
| Florida DOT rest area | General public: up to 3 hours; camping prohibited |
| Walmart parking lot | Individual manager approval and local law; RV policy is not blanket car-sleeping permission |
| Beach, street or public lot | Check local rules and posted hours; no statewide overnight permission |
| Forest or primitive site | Check the land manager’s designated camping, permit and vehicle-access rules |
Can you sleep in your car at a rest stop in Florida?
FDOT allows the general public to use its rest areas for up to three hours. Its governing rule prohibits camping and parking beyond three hours, with a separate commercial-driver exception. Do not plan an eight-hour overnight stay at a Florida rest area.
FDOT’s FAQ describes a ten-hour period for commercial motor vehicle operators subject to hours-of-service requirements. This is not a ten-hour allowance for someone vacationing in a car, van or RV. Follow the signs at the facility and leave within the applicable limit. If you are too tired to continue, stop driving and arrange a safe alternative rather than pushing on fatigued.
Does Walmart allow overnight parking in Florida?
Walmart’s corporate FAQ permits RV parking as individual stores are able, subject to manager permission, available space and local laws. That policy is not a statewide guarantee, and it does not expressly grant every passenger car permission for sleeping overnight.
Call or speak to the specific store manager. Explain your vehicle and that you intend to sleep in it, ask whether overnight parking is allowed, and confirm where and how long you may park. A manager’s permission does not override local restrictions. If permission is absent, denied or unclear, use another approved location.
- Never rely solely on an app, a blog, other parked vehicles or a previous visit.
- Keep your vehicle within the approved space and time; do not spread out tents, chairs or cooking equipment.
- Private businesses and truck stops each have their own rules. Ask directly rather than assuming another chain’s policy applies.
Plan a safer night in a car or van
Have your overnight location approved before the evening, arrive in daylight when possible and keep a backup campground or lodging option. Florida heat and humidity can make a closed vehicle unsuitable for sleeping even after sunset; choose another form of shelter when conditions are unsafe.
- Do not run the engine, a fuel-burning heater, stove or generator to sleep. Carbon monoxide is a serious risk.
- Keep exits accessible, valuables out of sight and a charged phone within reach. Share your location with someone you trust.
- Use safe ventilation and insect screens when conditions permit, but do not treat a small fan as protection against dangerous heat.
- Use actual restroom facilities and dispose of waste properly; a parking lot is not a campsite with sanitation services.
- Avoid alcohol or drugs when using a vehicle for shelter. Florida DUI law covers driving or actual physical control of a vehicle; sleeping is not an automatic defense.
- Move to a sturdy building for severe weather. Choose lodging if you cannot rest safely and legally in the vehicle.
Campgrounds to contact about your sleeping setup
Start with the directory listings below to compare locations and facilities, then contact the operator. These are not verified car-sleeping approvals. Ask: ‘Can I reserve a site and sleep inside my [vehicle type], without a tent or RV? Which site type should I select?’
Confirm showers, drinking water, arrival hours, total fees and any vehicle or equipment restrictions. A paid site with confirmed permission is a more dependable full-night plan than assuming a free parking lot will work.

View campgroundCommon questions
Can I sleep overnight at a Florida rest area?
Not as an overnight camping plan. FDOT limits general-public parking to three hours and prohibits camping. The separate commercial-driver allowance does not apply to ordinary recreational travelers.
Is Walmart overnight parking in Florida guaranteed?
No. Individual store managers decide based on space and local law, and the corporate FAQ addresses RVs. Ask the specific store about your vehicle and sleeping plan; do not assume permission.
Where can I go van camping in Florida?
Choose a designated campground or another legally permitted camping location that confirms your van is accepted. Check equipment rules, permits, access and current restrictions with the operator before traveling.
Can I sleep in a car in a Florida beach parking lot?
There is no blanket statewide permission. Check the local ordinance, posted lot hours and the operator’s rules. Reserve an approved campground rather than assuming a beach lot allows overnight stays.
